My Refusal To Remain Silent:
A Press Release from the (SHU).

of parole, scparation from the other prisoners, slitary confinement (usually in Maximum
Security Wings ofthe Prison), transfers from one prison o another, beatings, bad food. It
brings down on you the entire puniive and repressive force of a completely totalitarian
system,

Afer having been the subject of a murder charge, and being convicted years
afterwards. | have anticipated the stte attemping to silence me in a varicty of ways.
‘The conviction has paved the way and made t easy to keep me isolated and justify it by
screaming |am a security threat o the Indiana Prison population. But what people are.
ot awae of, or not being told is prison authorities do what's necessary to make prisoners
ook like the bad guy. Doing this, the pison authorities put themselves in a win-win
tuation as long as they can say a prisoner is violating prison rules. It could serve to.
justify a prisoner’s placement in controlled eavironments such as the Indiana Security
Housing Unit. The Judge who convicted me of the murder, in his sentencing order
recommended that the Indiana Dept. of corrections place me in an out of stat facilty to
complete my sentence.
“This recommendation became an issue during my sentencing hearing, due 10 the
case being the death of an Indiana State Prison Guard. The judge, my family, and
friends, all anticipated prison guards trying to kill me or etaiate in some kind of a way.
T've been in the Indiana Prison System since 1987. Personally, | knew that it would not
be a nice road after the conviction.
“The Indiana Department of Corrections via the commissioner had the
classfication department at “Supermax” another control unit. To transfer me on January
31,2003 to the Wabash Valley corectional facility and placed me on another control
unit, The Security Housing Unit (The SHU). I's almost been (2) years now, and there
has been many atacks, some opely and others psychological. Prison authoriies here are
in most ways causing more psychological stress than physical harm. When I arrived at
this facility, I only had (1) minor (c) offence against me. Staff working the (SHU)
obviously have been encouraged to fle @ host of unwarranted conduct reports against me.
‘Doing so, allows them to build a justifiable argument for why 'm being held here.
(Chronology of Attack)
1). On 11-21-03 1 was asked by anothe offender tosend him some newspapers
1 gavethese newspapers o an employee asigned o the (SHU). This guard walked from
my assgned cell and went up front. He conspied o sct me up taping a marjuana sick
1 the insde of the newspaper. This guard wanted to give the (SHU) unit a reason to
justiy keeping me hre. He then filed conduct report against me for possesson of a
controlied substance. His words were believed, | was tken t0 hearing and found guilly
of posession on 12-3-03. They placed me on a phone reticion for (2) months. They
deprived me of (90) days. Then they demoted me from clear conduct status (1) t0 2),
‘which s (60)days loss. This was thestartof a eries of manufactured, conspiratorial
conduct eports.
2). On 4-10-04 (5) months later | was falely attacked by another (SHU) guard
that | hd never sn before. This guard during his security rounds was asked by a
prisoner 0 hand me a magazine. He refused to hand me the magazine, 1 1old i tht
wasreal ety notbringing it o me. This gurd I the it and fild a charge against me
forintmidation, which is considered almost n the same context s treatcning charge

fears on my murder convicton to ncit hosiityin the board who would be conducing.
the bogus hearing on me. On 4/15/04 the hearing was held, 1 plcad not guly. The
hearing chairman once again uledin favor of the guard who lid but gotthe protecton of
s comrades. The conduct adjustment boad found me guilty of inimidation. They
targeted my outside communication again , by depriving me rom my use of the phone
for (60)days. This was the second seious conduct report 've had i over 10 years,
3). On 6/9/04 (2) months o 50 lter I came under attack once again by (SHU)
saff. This wasa day several of us wer engaged in group exercie. We were chanting
“Power o the people” caught up i the positive energy of the workout. On 610/04 me
and another prisoner were scrved conduct reports fo “threatening” another seious
offense. This guard intentionally twistd our words saying on the report we were
chanting “fuck th Police” kllthe police. He twisted our words so tha he could draw
negativeatention on once again. On 6/15/04 during the haring, | plead not guilly.
Afer a bogus deliberation they found me guilty of threatening. Even the guard was never
on the ranges where our cels are. He caims he heard us over (12) other voices from an
audio speaker where he sa i a control booth. | was placed on (2) more months of phone
restiction this was bogus. Also, my (3*) majo orserous conduct eport. As you can
see,now hey can paint a negalive picture of me.
4). On /10104 while 1 was out of my cellfor recreation for th day, unit guards
searched my cel arbitrarily. One of these guards s a defendant in & lawsui | have ina
Sullvan Courtroom here n Indian. They entered my cel olely o find something (o
continue th series o bogus conduct reports being fled against me. They found a haf of
& razor in my cel and ook it and filed a eport for possesson of an unauthorized weapon.

The chairman changed this charge from a “class B" o class “C" and found me guilty.
They put me on a 30) day foodcommissary restrition.
On 9/4/041 had a confronation with a guard (fmale) bout a phone relted ssue.
She cursed me out and said she would fx me. The same female guard passed out the !
Hunch trays and | discovered (2) Big bugs inside my tray. I beleve she planted tem in
my food in an atempt 0 intmidate me. I've fled 8 complant 0 the Govemor's affce
and the commissioner'soffce.
Al o the conduct reports | mentioned above never had any corroborating saff
witness statements. But they sill found me gilty. I needed to compile this nformation
and ge it out 0 you. ‘The Statc of Indiana and the Indiana Department of corrctions are
also helping prisoners slander my name. Doing this, it helps o urther their
peychologial warfure against my fight against sensory deprivations. Prisonercratsand

(Secured Housing Unif). On 9/4/04 one of the offcers passing out the daily food trays
for prisoncrs, gave Leonard B. McQuay a tray with bugainit. There is no question that
Leonard McQuay has been the trget of LD.0.C. employes hostiliy dus o his being
accused of being the pepetrator in the murder of Prison guard. He has been th target
of unchallengeable conduet report, and verbal disrespect by your offcers. We demand a
realinvestigaion ntothese reports and the ltest ncident concerning bugs been pt in
thisprisoners tay. 1 willbe notifing the Governor's officeon this matter a5 well
